According to the latest information from the Vietnam Trade Remedies Authority (Ministry of Industry and Trade), on December 19, 2025, the U.S. Department of Commerce (DOC) issued its final determination in the countervailing and anti-dumping investigation of imported hard gelatin capsules (HS codes 9602.00.1040 and 9602.00.5010) from Vietnam.
The case was initiated in November 2024, with the plaintiff being Lonza Greenwood LLC, which accused two Vietnamese companies of dumping and receiving subsidies.
At the time, the plaintiff cited that total imports of the product from Vietnam in 2023 amounted to around USD 26 million; imports from China totaled USD 49 million, India USD 67 million, and Brazil USD 4 million. According to the U.S. International Trade Commission (ITC), imports from Vietnam accounted for about 12% of the total imports of the investigated product into the U.S.
On May 23, 2025, the DOC issued its preliminary determination.
In this case, Vietnam had only one mandatory respondent exporting the investigated product to the U.S.; therefore, the subsidy and dumping margins applied to the mandatory respondent were extended to the entire industry.
According to the final determination, the final subsidy margin and anti-dumping margin for Vietnamese imports were set as follows: the final subsidy margin is 2.45%, and the final anti-dumping margin (after deducting the export subsidy margin) is 46.24%.
At the same time, the U.S. conducted countervailing and anti-dumping investigations for the same product imported from Brazil, China, and India.
Thus, the anti-dumping margin for Vietnamese products is higher than that for products from China and India but lower than that for Brazilian products. Vietnam’s subsidy margin is the lowest among the investigated countries.
The Vietnam Trade Remedies Authority stated that the U.S. International Trade Commission (ITC) is still conducting its injury investigation and will soon issue a final determination to decide whether countervailing and anti-dumping measures will be applied to imported hard gelatin capsules from the investigated countries.
Any tariff orders, if imposed, are expected to be announced in February 2026.
The Trade Remedies Authority recommends that relevant businesses continue to monitor the developments of the case and prepare appropriate response strategies for the upcoming period.
